TERMS OF SERVICE

Welcome to House of Aalaya. These Terms of Service govern your access to and use of our website, houseofaalaya.in, and your purchase of products through our online store.

By accessing our website or placing an order, you agree to be bound by these Terms of Service. Please read them carefully before making a purchase.

1. ABOUT HOUSE OF AALAYA

House of Aalaya currently operates as an online store and offers shipping within India as well as internationally.

2. ELIGIBILITY TO PURCHASE

Our products are available for customers of all age groups.

If a customer is a minor, the purchase should be made with the knowledge and consent of a parent or legal guardian.

By placing an order, you confirm that the information provided by you is accurate and complete.

3. PRODUCTS AND PRODUCT INFORMATION

We make every effort to display our products, colours, patterns, fabrics, measurements and other details as accurately as possible.

However, slight variations in colour may occur due to:

  • Lighting conditions during photography
  • Different screens and display settings
  • Camera and image-processing differences
  • The natural characteristics of fabrics and dyes

Such minor variations shall not be considered a product defect.

For a better shopping experience, customers are advised to carefully refer to the product description, size chart and wash-care instructions provided on the respective product page before placing an order.

4. SIZE AND PRODUCT SELECTION

Customers are responsible for selecting the appropriate size and product variant before placing an order.

Please refer to the size chart provided on the respective product page wherever applicable.

House of Aalaya shall not be responsible for incorrect size selection made by the customer.

Customers are encouraged to review all available product information before completing their purchase.

5. WASH CARE

Customers are advised to follow the wash-care instructions mentioned on the respective product page or provided with the product.

Improper washing, handling, ironing, drying, storage or use of unsuitable detergents may affect the colour, texture, shape or overall appearance of the garment.

Damage resulting from improper care or failure to follow the recommended wash-care instructions will not be considered a manufacturing or product defect.

6. PRICING AND GST

All product prices displayed on our website are inclusive of applicable GST, unless otherwise specifically stated.

House of Aalaya reserves the right to change product prices, offers, discounts and promotions at any time without prior notice.

Any price change will not affect orders that have already been successfully confirmed and paid for, subject to the applicable order terms.

7. PAYMENTS

House of Aalaya accepts online payments only.

Cash on Delivery (COD) is not available.

Orders will be processed only after successful confirmation of payment.

Customers are responsible for ensuring that the payment and contact information provided during checkout is accurate.

8. ORDER CONFIRMATION

Once an order is successfully placed and payment is received, an order confirmation may be sent to the email address or contact details provided by the customer.

An order may be cancelled by House of Aalaya in exceptional circumstances, including product unavailability, pricing or technical errors, suspected fraudulent transactions, or other circumstances beyond our reasonable control.

In such cases, any applicable refund will be processed through the original payment method or an appropriate payment process.

9. QUALITY CHECK

Before shipment, products undergo a quality-control inspection by the House of Aalaya team.

Products are checked for visible damages, defects and other quality issues before being packed and dispatched.

We take reasonable care to ensure that products reach customers in proper condition.

10. SHIPPING

House of Aalaya offers:

  • Shipping across India
  • International shipping

Shipping charges are payable by the customer and will be displayed or communicated as applicable before order completion.

Delivery timelines may vary depending on the destination, courier service, customs procedures, weather conditions, public holidays and other circumstances beyond our control.

For international orders, the customer is responsible for any applicable customs duties, import taxes, local taxes or other charges imposed by the destination country, unless otherwise stated.

House of Aalaya is not responsible for delays caused by customs clearance, courier networks or circumstances beyond our reasonable control.

11. ORDER CANCELLATION

Customers may request cancellation of an order before the order is shipped.

Once the order has been shipped, cancellation requests will generally not be accepted.

Customers should contact House of Aalaya as soon as possible if they wish to request a cancellation.

Cancellation requests can be made through our official WhatsApp support or email.

12. RETURNS AND EXCHANGES

House of Aalaya does not offer returns or exchanges for change of mind or personal preferences, including:

  • Dislike of the product
  • Colour preference
  • Pattern preference
  • Fabric preference
  • Style preference
  • Incorrect size selection by the customer
  • Change of mind after purchase

We therefore request customers to carefully review the product images, description, size chart and wash-care information before placing an order.

13. DAMAGED OR INCORRECT PRODUCTS

If a product is received in a damaged condition or there is another genuine product-related issue, the customer must contact House of Aalaya within 5 working days from the date of receiving the parcel.

For any damage-related claim, the customer must provide a continuous, uncut parcel-unboxing video showing:

  1. The unopened package
  2. The opening of the package
  3. The product received
  4. The damage or issue clearly visible

The unboxing video should be continuous and unedited.

Claims without appropriate video proof may not be accepted.

14. INSPECTION OF DAMAGE CLAIMS

All damage-related claims will be reviewed by the House of Aalaya team.

If the issue is found to be genuine after inspection, the customer will be required to return the product as instructed by our team.

Once the returned product is received and inspected by House of Aalaya, an exchange/replacement will be initiated where applicable.

Refunds will not be provided for approved damage claims.

Replacement may be provided with:

  • The same product, subject to availability; or
  • Another product of the customer's choice, subject to applicable price differences and availability.

The final resolution will be determined after inspection of the returned product.

15. CONDITIONS FOR DAMAGE CLAIMS

A damage claim may not be accepted where the damage appears to have resulted from:

  • Customer handling or misuse
  • Washing or improper cleaning
  • Improper ironing
  • Improper storage
  • Normal wear and tear
  • Failure to follow wash-care instructions
  • Alterations or modifications made by the customer
  • Damage occurring after delivery due to circumstances unrelated to the product's condition at the time of delivery

Customers must not use, wash, alter or otherwise modify the product before reporting a suspected damage issue.

16. CUSTOMISED AND MADE-TO-ORDER PRODUCTS

Certain products may be offered as customised, made-to-order or preorder products.

Such products will be clearly mentioned in the respective product description.

Preorders will be accepted only for products specifically identified as preorder/customised/made-to-order items.

Customers should carefully review the product-specific terms and expected processing timeline before placing such orders.

17. INTELLECTUAL PROPERTY

All content available on the House of Aalaya website, including but not limited to:

  • Brand name
  • Logo
  • Product photographs
  • Videos
  • Graphics
  • Product descriptions
  • Text
  • Designs
  • Website content

is owned by or used by House of Aalaya with appropriate rights and may not be copied, reproduced, modified, distributed or commercially used without prior written permission.

18. WEBSITE USE

Customers agree to use the website only for lawful purposes.

You must not:

  • Attempt to interfere with the operation or security of the website
  • Use the website for fraudulent activities
  • Submit false or misleading information
  • Attempt unauthorised access to website systems
  • Copy or misuse website content
  • Use the website in a manner that may harm House of Aalaya or other customers

House of Aalaya reserves the right to restrict or terminate access to the website where misuse or unlawful activity is identified.

19. WEBSITE ACCURACY AND AVAILABILITY

We make reasonable efforts to keep product information, pricing, availability and website content accurate.

However, occasional typographical errors, technical errors, pricing errors or product availability issues may occur.

House of Aalaya reserves the right to correct such errors and update information when necessary.

We also cannot guarantee that the website will always be available without interruption or technical issues.

20. LIMITATION OF LIABILITY

House of Aalaya shall not be responsible for delays, interruptions or failures caused by circumstances beyond our reasonable control, including courier delays, natural events, government restrictions, customs delays, technical failures, strikes or other unforeseen circumstances.

Our responsibility in relation to a product purchased through the website shall be limited to the remedies specifically provided under these Terms of Service and applicable law.

Nothing in these Terms is intended to exclude or limit any rights or protections that cannot legally be excluded under applicable law.

21. CHANGES TO THESE TERMS

House of Aalaya reserves the right to update or modify these Terms of Service from time to time.

Any updated Terms will be published on this page with the revised "Last Updated" date.

22. GOVERNING LAW AND JURISDICTION

These Terms of Service shall be governed by and interpreted in accordance with the applicable laws of India.

Subject to applicable law, any disputes arising in connection with these Terms or purchases made through House of Aalaya shall be subject to the jurisdiction of the appropriate courts in Kaniyakumari District, Tamil Nadu.

Orders & Payment

All prices are listed in Indian Rupees (INR) and inclusive of applicable taxes. Orders are confirmed only after successful payment.

Product Accuracy

Colours may vary slightly from what you see on screen due to handloom character and photography lighting. We describe each weave as accurately as possible.

Returns & Refunds

Unused items with tags intact can be returned within 7 days of delivery. Refunds are processed within 5–7 business days of receiving the returned item.

Intellectual Property
